1. Acknowledgment of Risk
By participating in the Hot & Spicy Speed Challenge (“the Event”), the Participant acknowledges and accepts that the consumption of spicy foods can involve inherent risks, including but not limited to: physical discomfort, allergic reactions, gastrointestinal distress, injury, or other adverse health effects.
2. Medical Condition and Fitness to Participate
The Participant affirms that they are in good health and have no known medical conditions that would be aggravated by the consumption of extremely spicy foods. The Participant agrees to disclose any relevant allergies or health conditions to the Event Organiser in advance.
3. Voluntary Participation
Participation in the Event is entirely voluntary. The Participant confirms they are entering the Event at their own risk and discretion.
4. Waiver and Release of Liability
The Participant hereby waives, releases, and discharges the Event Organiser, sponsors, affiliates, and venue operators from any and all liability for claims, losses, injuries, damages, or expenses of any kind arising from or related to participation in the Event. This includes any claims of negligence.
5. Emergency Medical Assistance
The Event does not provide medical treatment or assistance but may contact emergency services if required. Participants are responsible for their own medical care and any associated costs. Participants agree to bear any costs associated with such services.
6. Age Requirement
Participants must be at least 18 years of age on the day of the Event. Valid identification will be required as proof of age.
7. Photography and Media Release
The Participant grants permission for the Event Organisers to photograph, film, or record their participation. Such media may be used for promotional or marketing purposes without compensation or further approval.
8. Right to Refuse Participation
The Event Organisers reserve the right to refuse entry or remove any Participant who appears to be under the influence of alcohol or drugs, is unwell, or poses a risk to themselves or others.
9. Contest Regulations and Final Authority
The challenge record and timing will be taken and verified by designated Burwood Chinatown staff. Burwood Chinatown reserves all rights related to the event, including but not limited to disqualification, winner selection, and challenge format. All decisions made by Burwood Chinatown are final and binding in all matters related to the competition.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws, and any disputes shall be subject to the exclusive jurisdiction of the courts therein.
